1. Introduction

GROW (“GROW”, “we”, “us”) is an artist commons operated by Lenguart LLC.

By accessing or using GROW, including the GROW Extranet, you agree to these Terms of Service (“Terms”). If you do not agree to these Terms, you may not use GROW.

GROW supports the submission and preparation of galleries for consideration by Museum For A Rainy Day, a curated digital museum.

3. Scope of GROW

GROW is a restricted, account-based system intended for artists and contributors.

At this stage, GROW is used to authenticate participants, collect gallery submissions, manage submission metadata, and support curatorial review.

GROW is not a public social network and does not provide public user profiles.

4. Eligibility and Accounts

4.1 Account Access

Access to GROW requires signing in via Google Sign-In.

By signing in, you represent that you are legally capable of entering into these Terms and that the information associated with your account is accurate.

You are responsible for maintaining the security of your sign-in credentials.

4.2 One Account per Person

Each individual may maintain only one GROW account unless explicitly authorized otherwise.

Accounts are personal and may not be transferred or shared.

5. Submissions and Content

5.1 Gallery Submissions

When you submit a gallery in GROW, you acknowledge and agree that a gallery consists of a fixed set of images and metadata.

Once submitted, images cannot be replaced and the sequence of images cannot be changed. Gallery metadata may be locked after submission. The gallery remains archived as submitted.

A submitted gallery is treated as a finished exhibition for curatorial consideration.

5.2 Artist Responsibility

You represent and warrant that you own the rights to the content you submit or have the necessary permissions to submit it.

You must not submit content that infringes copyright or other intellectual property rights, impersonates another artist or individual, or is unlawful, deceptive, or misleading.

You acknowledge that GROW relies on the representations you make regarding ownership and rights clearance when reviewing submissions.

5.3 No Guarantee of Selection

Submission through GROW does not guarantee acceptance, exhibition, feedback, or publication. Curatorial decisions are discretionary and final.

6. License to Review and Display

By submitting content through GROW, you grant Lenguart LLC a non-exclusive, limited license to review submitted content, internally evaluate submissions, and display selected content within Museum For A Rainy Day and related platforms.

This license is limited to purposes consistent with the operation and curation of the Museum.

7. Moderation and Platform Integrity

We reserve the right to review submissions for compliance with these Terms, restrict or remove content that violates these Terms, and suspend or terminate accounts that engage in misuse, fraud, or abuse.

Moderation decisions are made to protect artists, the Museum, and the integrity of the platform.

8. Account Suspension and Termination

We may suspend or terminate your account if you violate these Terms, submit fraudulent or infringing content, or if required by law or safety considerations.

You may request account deletion at any time, subject to legal retention obligations and archival requirements related to submitted galleries.

9. Intellectual Property

Except for content you submit, all platform software, design, and branding associated with GROW are the property of Lenguart LLC.

You may not copy or reverse engineer the platform, scrape or harvest data, or use GROW for unauthorized commercial purposes.

10. Indemnification

You agree to indemnify and hold harmless Lenguart LLC, its officers, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) arising out of or related to your content submitted through GROW, any allegation that submitted content infringes copyright, trademark, or other intellectual property rights, misrepresentation of authorship or ownership, or your violation of these Terms.

This obligation applies only to the extent that such claims arise from your actions or submissions.

11. Disclaimer of Warranties

GROW is provided “as is” and “as available.”

We do not guarantee uninterrupted access, acceptance of submissions, or error-free operation. To the fullest extent permitted by law, we disclaim all warranties, express or implied.

12. Limitation of Liability

To the fullest extent permitted by law, Lenguart LLC shall not be liable for loss of submissions, loss of opportunity, indirect or consequential damages, or curatorial decisions or outcomes.

Use of GROW is at your own risk.

13. Privacy

Use of GROW is governed by our Privacy Policy, which explains how personal data is handled.

14. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.

15. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be posted within GROW with a revised date. Continued use of GROW after changes are posted constitutes acceptance of the updated Terms.
